Feeling Pressured to Become an Agent: What Are My Rights as a Fixed-Term Employee at LIC?

vinaysingh49
I am employed as a fixed-term contractual employee at LIC of India. Initially, my contract was for 3 years, then extended for another 2 years. After completing 5 years, it was extended for another 1 year, making a total service period of 6 years as a contractual engagement. Suddenly, LIC management pressured me to accept a LIC agency and become an agent. My work profile is similar to that of a development officer at the present time.

Rights as a fixed-term contractual employee

Please suggest what my rights are as a fixed-term contractual employee. Can I demand a permanent job? Does LIC have the right to offer employment of this type?

Mutual Rights and Obligations in Fixed-term Contractual Appointments

Normally, the mutual rights and obligations of the parties are determined by the contract of employment in the case of fixed-term contractual appointments too. Of course, certain employment benefits like gratuity are determinable as per the total length of continuous service rendered by the FTC employee, notwithstanding the occasional breaks of short durations in between the expiry and renewal of the contract from time to time, depending on the exigencies of job requirements. However, I do not believe that the passage of time would confer any special right on the FTC employee to claim permanency unless the entire contract can be proved to be a sham one to circumvent the provisions of any law relating to industrial employment.

Service Regulations of LIC

LIC, being a public sector undertaking, has its own service regulations. Maybe on the expiry of the FTC employment, as a gesture of goodwill, the management offers you an opportunity in the form of a contract for service. Acceptance or outright rejection is your choice only. I do not think that an FTC employee like yourself has any right to permanency under normal circumstances.

LIC of India has no power to appoint FTC employees. According to the LIC Act of 1956, they can only appoint permanent and temporary employees.

Please suggest,

I was appointed in a company through a Staffing Consultancy on a six-month contract. The contract is renewable after six months. After one year, I had to transfer to another Staffing Consultancy, but the management and conditions remained the same with a six-month contract.

In the second company, I worked for 4.5 years, and in the first company, I worked for 1 year. I have now been terminated. Am I eligible for gratuity and bonus?

Ajay

I have been working at LIC for 6 years. My recruitment was for the position of sensation post. I have followed all procedures like a regular employee, such as reservation, exams, interviews, etc. After my appointment, they did not provide me with an appointment letter. Instead, they gave me 42 days of leave per year. Suddenly, after 2 years, they changed my TDS certificate and issued me Form 16A instead of Form 16. By the 5th year, management forced me to sign a letter with the wording: "I am a contractual employee recruited initially for 3 years. After three years, it was extended for another 2 years. In this year, it was extended for another 1 year. After this 1 year, my contract is set to expire automatically, and I have to exit without any notice." I denied signing the letter. Consequently, they warned me that my last year in this corporation would end on March 31, 2018. They categorized me as an employee of category 2 in the reservation roster. I have requested my appointment letter, but they have not provided it. How can I seek relief? Please help me.
