Is Dengue Death Considered an Accident for Insurance Claims? Seeking Advice on Consumer Court Options

Dear Seniors, One of our employees (Private Limited - Manufacturing Company at Pune) died on 17th September 2016 due to Dengue in a hospital. He was 34 years old without any medical history. He had home loan insurance with HDFC Ergo. Due to his death, we have claimed for his Home Loan Insurance, which was rejected by HDFC Ergo stating the reason that Dengue is not covered under Critical Illness as well as Accident Category. He was also covered under GPA policy, and as per TPA, Dengue death is not considered an accident, so it is not covered, and insurance under GPA cannot be claimed. Can we refer to the below case to file a case in Consumer Court Pune? If you have any second opinion, please advise.

It will not be possible to give a suitable answer to your query unless what is stated in the Policy Note is known. Whether the policy issued by the HDFC Ergo covers natural death or only death arising out of any accident?

The policy covers accidental death and critical illnesses only.
