Understanding the Payment of Wages (Amendment) Act, 2017: What Changed and Why It Matters

The Payment of Wages (Amendment) Act, 2017 was passed on 15th February 2017, with retrospective effect (w.e.f. 28th December 2016) by repealing the Payment of Wages (Amendment) Ordinance, 2016. The Payment of Wages (Amendment) Ordinance, 2016 was passed on 28th December 2016, containing the same provisions as those given in the 2017 amendment act.

This amendment is not of much benefit to employees.

The Act is not applicable to employees with a salary above Rs 18,000 per month. Appropriate governments have to specify each and every establishment where the amendment is applicable, i.e., which establishment shall pay through the bank.

It would have been better if the government had the power to apply it to a class of establishments.

In the recent change in the Payment of Wages Act, it was stipulated that wages shall be paid either through a cheque or by crediting into the employee's bank account by the employer. However, as mentioned by a few friends, wages have been revised to Rs. 18,000 per month. Is there any gazette notification available? Please share.

The attachment you shared does not contain an amendment in wages escalation to 18000/-. Please share the notification if you have it.

I am sharing the Govt notification on the specification of Rs. 18,000/- as wages as per Section 6(6) of the Payment of Wages Act, 1936.

Now, as per the recent notification, Rs.24,000 wages instead of Rs.18,000/- are to be considered.

I have worked in one organization and left in the month of November 2016. 35 days' salary is pending with the company, i.e., October 16-31 days and November 2016 - 5 days. I have approached HR executives for the release of my salary. Now they are telling me that the records are not available.

1) How can I get my salary from the company?
2) May I approach the labor department for my salary? Please suggest suitable legal remedies for this.
