Understanding Overtime Pay: How Much and When for Drivers and Office Boys?

Dear Sir,

I would like to know at what rate we need to pay overtime to drivers and office boys. What is the minimum number of hours of duty they need to perform, and from what time will overtime be applicable?

48 hours per week is their duty; the balance is overtime. As per the Factory Act of 1948, they cannot work more than 40 hours of overtime per week. The rate is simply double the wages payable per hour.

Understanding Spread Over Time for Drivers

For drivers, there is something called spread over time. The working hours are not the standard 8 hours as in a factory. A driver will work for a period of 8 hours per day, which can be spread over 10.5 hours. If the person is retained for over 10.5 hours in a day, while having been on duty for less than 8 hours, they are still entitled to overtime beyond the 10.5 hours. However, if they have worked, say, 9 hours without spreading over 10.5 hours in the day, then their overtime starts ticking the moment their 8 working hours are completed.
