Can I Take Legal Action for Unjust Termination and Withheld Salary? Seeking Advice

Hello team,

Actually, I was working with a mobile insurance company. Suddenly, one day my senior terminated me without any reason. They also withheld my salary for November and half of January. When I asked to release my salary, they said that due to a mistake in bill making while processing insurance, I had erred in the date. Therefore, they would not proceed with my salary.

I have requested them many times, but they do not seem to care. Now, please tell me, can I file a case in the labor court against the company and my seniors?

Dear Javed,

Try to convince your seniors to release your salary. There is no point in unnecessarily fighting with the company. If they fail, then approach the Labour Officer/Commissioner's Office for help, but remember you will have to quit.

Such deductions are not allowed. Human mistakes are bound to happen. If you made that mistake without acting rashly, you can lodge a complaint with the labor department. Follow this Archive for November 2016.

Actually, I have tried many times to convince my seniors, but they are playing games with me because they are also refusing to provide the N.O.C. from the retailer's side, where the company requires me to sell insurance for mobile phones. For the FNF company, an NOC from the retailer is necessary for me, but my seniors refuse to hand over the NOC to me from the retailer.

Senior, I don't understand why you said, "Remember you have to quit?" Please clarify this statement. Please provide me with a solution.

Dear Javed,

Please approach the nearest office or the area under the jurisdiction of ALC and file a complaint against the company. Ensure that the seniors are made a party to the complaint. The F&F should be cleared within the stipulated time.
