Worried About Job Security After Unscheduled Leaves and Health-Related Absence?

Rakesh2575
I joined a private limited company in September 2016, and I am not confirmed yet. I took five unscheduled leaves during this period. My manager has given me a final warning for my actions. Recently, I had a health issue and had to take three days off. I only informed them about my situation through a text message. I am concerned if this will lead to termination of my employment with the organization.
Labour Law Index
Understanding Leave Entitlements and Employment Rights

There are many issues here. First, labor laws entitle you to certain leaves irrespective of your company policy. Check whether you have transgressed these entitlements. Since you have not mentioned the nature of your business, kindly visit the website below to check your leave entitlement as per manufacturing or non-manufacturing concerns. Also, review the leaves under the Shops and Establishment Act of your state.

Secondly, if your health was so poor that no reasonable person would go to work in that condition, they cannot terminate you.

Termination During Probation

The company can terminate you without reason during probation. They do not need to confirm you; it's a choice lying entirely with them. In general, companies frown on leaves during probation and definitely don't like unscheduled and unapproved leave. It is natural that the company will, therefore, be unhappy.

Employee Behavior During Probation

It is generally considered that if an employee does not behave properly during probation, it's unlikely they will be a good employee during confirmed/permanent status. Sending out just an SMS during an absence, without even calling and informing the manager of your problem, is generally considered unacceptable.

Steps to Take if Facing Termination

If they decide to terminate, there is very little you can do. I suggest you go and apologize to your manager and explain the situation.
