ESIC Deduction - Exemption From Deduction If Work Not Labour Type?

monika paliwal
Hi All,
ESI limit is increased from 15000/- to 21000/-. My company is in electrification type work and we are enrolled in ESI, PF also.
We deduct ESI contribution from employees who is earning below 21000/-.
My current salary is 18000/- as HR executive, so due to new rule I am also in ESI deduction.
My question is my work is not of labour type... I sit in office so could I take exemption from deduction? or is it mandatory for all departments?

No where its mentioned as ESI is applicable for particular category of employees.
It is applicable for all the employees irrespective of permanent employees, office staffs, managers, casual employees, contractual employees etc...
Only criteria is the ceiling limit of 21000/-. So any employee who earns 2100/- and below are entitled for ESI coverage

if the establishment is covered under ESIC, then all employees below 21000 gross salary, have to be covered.

No way of getting exemption unless and otherwise you exceed the ceiling fixed in the ESI Act or providing equal or more benefit than the ESI corporation by your present company or organisation.
