Understanding CLRA: What's the Minimum Paid Notice Period for Termination?

lalitpahwa
Can someone please let me know what should be the minimum notice period to be paid to any employee under CLRA.

If we need to terminate the contract of an employee, what will be the minimum number of paid days we need to pay in lieu of the notice period. It would be a great help if you could reference a clause of an act.

Please read the terms of appointment for every individual. You must pay at least one month's wages to those who have completed more than six or twelve months.

Thank you.

The CLRA does not prescribe any notice period. It is to be a matter of agreement between the employer and the employee and therefore will be stipulated as a term of employment either in the letter of appointment or service rules/standing orders of the company.

Thank you both for the information. However, I need clarification. If an employer is mentioning a 30-day notice period in the appointment letter for contract employees, and the principal employer is paying 15 days' notice to their on-roll employees, is the principal employer liable to pay 30 days' notice to contract employees?

The appointment letter to contract workers is given by the contractor, not by the principal employer, as they are the employees of the contractor. If that is the case in your situation, the principal employer is not concerned with the terms of notice pay payable to contract workers, and they can adhere to the stipulation of 15 days' notice pay for on-roll employees.
