Construction Site Dilemma: Does a Batching Plant Fall Under the Factories Act?

Dear Sirs,

Please tell me, if a construction site is covered under BOCW Act, and a contractor has put a Concrete Batching Plant for site only. Is that Batching Plant coming under Factories Act? The produced concrete is used for that particular site.

Ten or more persons working with the aid of power = factory act applicable. To bypass the same, one must keep fewer than 10 persons at a single site on the payroll.

Ready-mix concrete plant serving the purpose of one BOCW site will fall under the BOCW Act.
