Can I Take Legal Action for Unpaid Notice Pay After Early Termination?

I had submitted my resignation on 09-11-2016, and as per the terms of my appointment, my notice period was one month. Accordingly, I requested to be relieved on the completion of the notice period, i.e., on 08-12-2016. However, they released me on 30-11-2016 without my consent. I did not ask for any reduction in my notice period. Now, I am claiming 8 days' notice pay as they terminated me during my notice period, but they are refusing to pay me the same. Can I take legal action? If so, how? Please advise.

As per the employment agreement, you are supposed to give one month's notice to the employer. The employer must find a suitable candidate for your replacement within 20-22 days, so they should relieve you beforehand. Legal action may not be of much help in this regard. Additionally, the amount of 8 days' notice will not cover the time and money spent on legal matters, to the best of my knowledge. Therefore, it is advisable to move on with your new assignment.
