How Can I Claim Gratuity and Dearness Allowance When My Employer Isn't Responding?

I was working with an educational institute from June 2010 to October 2015. As I completed 5.5 years of continuous service in the organization, I requested gratuity through a prescribed application on 19th December 2015. After following up continuously, they informed me that due to the initial 2 years of my employment being on a probation period, the actual period becomes 3.5 years, and hence I am not eligible for gratuity. I have asked them for a written explanation, but they are not responding at all.

Additionally, they have not paid me the dearness allowance pending since January 2015. I would appreciate your suggestions on further actions.

Dear Sachin,

As far as your case is concerned, it looks lawful from your side. It would be better if you could approach the labor office to file a complaint against the institution, or you can make a writ petition in the Labor Court. I am confident that you will win the case.
