Do We Need to Register Under Contract Labour Act for Hiring Security Guards?

Dear Seniors,

In our plant, 12 security guards are engaged. They were hired from a security agency on a contract basis. My scenario is:

1) As the principal employer, do we need to take registration under the Contract Labour (Regulation & Abolition) Act, 1970, in respect of the engagement of contract labour?

Please clarify.

The Contract Labour (Regulation and Abolition) Act, 1970 is applicable to:

(a) Every establishment in which twenty or more workmen are employed or were employed on any day of the preceding twelve months as contract labour.

(b) Every contractor who employs or who employed on any day of the preceding twelve months twenty or more workmen.

If you have not deployed 20 or more employees, then you need not take any registration. However, please note that if you deploy 20 or more personnel through various contractors' roles, then you have to obtain a Registration Certificate (RC) under the Act and provide details regarding all the contractors. The contractor will only be covered when they deploy 20 or more workers at your premises.
