How Do I Calculate Privilege Leave for a Worker with 226 Days and Special Leave?

Dear All,

As per the Factorise Act, a worker who has worked for a minimum of 240 days is eligible for Privilege Leave. Our calculation for Privilege Leaves is Present Days divided by 15. However, the worker has only worked 226 days and enjoyed 63 days of Special Leave (including the Weekly off). How can I calculate his Privilege Leave?

Dear Friend,

Please calculate only working days. As per FA, one Earned day has to be given for the last year (January to December period) working days divided by 20 (not for 15 days as per Act, divided by 20 days only). It may vary depending upon the working days of the employees. If an employee has worked below 240 days, then add the layoff days if any, and the availed earned leave days, including maternity leave for female employees, and calculate only for actual working days.

Eligibility for Earned Leave Under the Factories Act

Under the provisions of the Factories Act, 240 working days in a calendar year are required to be eligible for Earned Leave/Privilege Leave (including layoff, maternity leave, and EL enjoyed). However, EL is calculated based on actual working days.

One Earned Leave is provided for every 20 working days. You can calculate earned leave based on the actual working days in a year, i.e., 226/20 rounded off to the nearest full day. However, if your management allows one leave after 15 days, then calculate it as 226/15 rounded off.
