Struggling with Unpaid Final Settlement from My Former Employer – What Should I Do?

Dear sir,

I worked in an Indian MNC company as a civil engineer from May 2008 to February 2015. I resigned properly as per the appointment letter with a one-month notice period and obtained a clearance letter as well. However, the company has not yet cleared my final settlement, which includes gratuity, the notice period month's salary, and the remaining balance of leaves.

One important point to note is that I withdrew all my PF amount. Despite this, there has been no response from the company regarding the final settlement. How should I proceed? Your assistance would be greatly appreciated.

Steps to Claim Your Dues as a Civil Engineer

You worked as a Civil Engineer, so you need to make a submission of your dues payment under labor laws. There is a legal method available under labor laws to claim the earned amount of dues. Please write a Registered AD letter, enclosing copies of your previous communication with the company, requesting to make the FnF settlement within a maximum of 7 days.

Also, there is a prescribed Application for Gratuity form for claiming gratuity (as you are entitled to the gratuity amount also). Download it from the internet, fill out this application, and send it with these papers to the company's MD by name. Write in your letter to the MD that if it is settled, you will appreciate his intervention; otherwise, you will go to the proper authority under the law of the land to get your hard-earned money from the company.

Wait until you get back the Acknowledgement of the Registered post, and after you get back the AD, (a) file a gratuity claim before the Dy. Labour Commissioner for gratuity and (b) for the remaining calculated dues amount in the Assistant Labour Commissioner's office of the area where the company is located. Going by the brief you have given in your post, I find that you have a strong case, and you will win and get money shortly. Take the help of an advocate who deals with labor matters and labor departments for strategic assistance.
