Hi, I have a query. For less than 20 employees (14 employees only), if management agrees to payment of PF & ESIC, can we proceed with the registration of PF & ESIC, including deductions and payments? Can anyone please advise on this?
Sir, coverage under the ESI Act, 1948, and rules/regulations framed thereunder is based on the employment of 10 or more persons. If your factory/establishment is situated in an implemented area and employs 10 or more persons, it is already coverable, and there is no option for the employer except to comply with the said Act.
As you already have exceeded 10 employees, ESI is mandatory if it's in a coverable area. For EPF registration, you need 20 employees. Since you have less than 20 employees, yes, you can apply for voluntary registration.
