Internships and the Apprentices Act, 1961: Do Private Companies Need to Comply?

goyalanirudh
Does an internship hosted by a private company fall under the purview of the Apprentices Act, 1961?
Labour Law Index
Not every kind of company is covered under The Apprentices Act, 1961. The industry must be indulging in a "Designated Trade". The following are the designated trades:
[List of designated trades for Trade Apprentices: Directorate General of Training (DGT)](http://dget.nic.in/content/innerpage/list-of-designated-trades-for-trade-apprentices.php)

So, see first that they are covered here.

Interns are not apprentices. Apprentices are from a specific industry only, and the number, stipend, and conditions are governed by the apprentice advisory of the government. You need to follow the procedure, register with them, and then recruit in line with their approval.

Apart from that, an apprenticeship program may also be provided for in the certified standing orders.

Hello,

Thank you for your response. Is there any case law that states interns do not fall under the Apprentices Act?

There does not need to be a case law. The Apprentice Act is pretty clear on who can be an apprentice.

Is there any policy to hire academics who have graduated as interns or trainees?
