Gratuity Eligibility for Retired Government Employee: Is He Entitled After 5 Years?

vselvakkumar@yahoo.co.in
Sir,

We had appointed a retired government service employee in our institution, and he resigned from the service since his tenure exceeded 5 years. Could you please let me know if he may be eligible for Gratuity as per the law?

He is eligible for Gratuity if he has completed 4 years and 240 days of continuous service with a particular organization.

Thank you, Samar. Is any modification for the first five years of continuous service mandatory for eligible gratuity?
