Waiting for My Pending Salary and F&F Settlement: When Will I Get Paid?

I had given one month notice; it will complete on 22nd Dec 16. However, there is pending salary towards the company for about two months due to delays in the expense statement submission. Now that my expenses have been received by the company, they still have not disbursed my pending salary. When will they disburse my salary, along with the Full and Final (F&F) settlement or before the settlement? Please guide me.

Company is required to pay wages within the 7th to 10th of every month. Since you are already serving the notice period, it is advisable to wait for a few days for the F&F settlement to see if all dues are paid or not. If they don't pay, then you can claim together.

In my point of view, a company can hold one month's salary, which will be disbursed at the time of full and final settlement. An employer has no right to hold an employee's due salary even if he/she has resigned. However, if you are working there and are well aware of your company's financial status, two hypothetical conditions may arise:

1. There may be a financial problem with the employer, resulting in the inability to disburse two months' salary to all employees.
2. The employer may have disbursed salary to others but not to you.

If the first hypothesis is true, you should cooperate with your employer, and it is certain that you will receive all dues in the full and final settlement. However, if the second hypothesis is true, you should take action against the employer.
