Is It Legal for My Company to Fire Me and Withhold Documents Over a Dispute?

Plash Jindal
I worked for a company for one year. Now, I was serving my notice period. They fired me yesterday, claiming that I misbehaved with HR because I expressed my point of view regarding the issue of coming to work on Saturday, which is officially a day off, especially when I have no projects and am stuck. She found it offensive. Because of this, she fired me, claiming I misbehaved with her and refused the assigned duties. Now, they are not giving me the experience letter or documents. Can anyone tell me if this is legal or what I need to do?

Termination and Relieving Letters: Navigating Career Challenges

In legal terms, an employer issues a termination letter if it's a forced exit. In your case, only the termination letter can be issued, which is not a positive sign for your career. In the future, if you wish to showcase your experience at this company, it's better to end on a good note and try to obtain a relieving letter instead.

To do so, it's advisable to speak to your boss or a senior authority. Propose that they accept your resignation letter and issue a relieving letter to you. Secondly, ensure that they provide positive feedback to your next employer.

If you don't want to do this, then avoid mentioning this experience in your resume. It will help you settle into your next job.

Handling Personal Documents and Experience Letters

Documents related to educational or professional certificates are considered "personal assets." Not returning a "personal asset" to its rightful owner is defined as "abduction." Therefore, you should log a written complaint at the police station about the abduction of your personal asset. Take a copy of this complaint to HR and request the return of your valuable documents. If HR denies your request, ask the police to take action.

Regarding the experience letter, I think Neelima's suggestion is good: you don't need to mention it in your next updated resume.

Thanks.
