Stuck with Unpaid Salaries and a Rejected Resignation: How Can I Move Forward?

I worked in a company for one year, where I have pending salaries for six months. I received another job offer and submitted my resignation. However, my employer is rejecting my resignation and not providing the experience and relieving letter. He only replies to messages, does not pick up my calls, and does not come to the office for me to meet him. I am currently staying in Bangalore and am not a local resident. Can you please suggest what I should do?

What I could understand is that you have not been paid for 6 months. If this is correct, then just join another company -- explain the circumstances, show them the SMS's to explain why experience as well as a relieving letter cannot be provided.

You may approach the labor court to get your dues or go to civil court. A lawyer can guide you; it may involve sending a legal notice.

Demanding Outstanding Salary

For the outstanding salary of six months, you can demand it from the company in writing. You are entitled to your salary, and no one can forfeit it like that. Depending on the nature of your job and the company, you have to approach the appropriate forum to recover the same.

Resignation and Acknowledgment

Regarding the resignation part, did the company reject your resignation in writing? If not, then it will be deemed that they have accepted the resignation. I hope you have an acknowledgment of the submission of your resignation too.

Convincing the New Employer

Try to "convince" the new company about the situation by showing your appointment and resignation letters since it will be difficult to get the experience and relieving letter in this kind of situation.
