Yes, it is necessary to grant paid maternity leave to a female employee who has put in about 3 months of service. You have not mentioned how long this employee has been with you, so I presume she must have been working for more than 3 months. I remember we were disbursing one additional benefit by a lump sum amount of Rs 1000 (approx.), called a medical bonus, to the employee proceeding on maternity leave. We are supposed to maintain a register of employees proceeding on maternity leave in the prescribed format, as per the Maternity Benefit Act 1961. Section 12 of the act prohibits the employer from dismissing or terminating any employment if an employee is absent as per the provisions of this act. Similarly, the employer cannot make any changes to the service conditions during such time.
