When Gratuity Becomes Payable

A person who is eligible for payment of gratuity under this Act, or any person authorized in writing to act on their behalf, shall send a written application to the employer within 30 days using Form I for payment of such gratuity. Where the date of superannuation or retirement is known, this form should be submitted 30 days before such date. A nominee shall apply for gratuity using Form J within 30 days of it becoming payable. A legal heir may apply using Form H within 30 days of it becoming payable.

Gratuity Payment Process According to the Gratuity Act

Section 4(1)(2)(3) of the Gratuity Act requires that gratuity shall be paid to an employee upon the termination of their employment after they have rendered continuous service for not less than five years. Rules 7 and 8 of the Gratuity rules require that an employee who is eligible for the payment of gratuity shall apply for it within thirty days from the date the gratuity becomes payable, using Form I to the employer. Within fifteen days of receiving an application under Rule 7 for the payment of gratuity, the employer shall issue a notice in Form L to the applicant employee, nominee, or legal heir, as the case may be. This notice will specify the amount of gratuity payable and fix a date, not later than the thirtieth day after the receipt of the application, for payment.
