Statutory obligations regarding engagement of contract labor

I am attached to a private limited company engaged in the construction of government projects in Bihar, Jharkhand, and West Bengal. To carry out construction works, we are required to engage contract labor.

What are the statutory obligations we will have to comply with?

Guidelines for Engaging Contract Labour

Ensure compliance with the following guidelines when engaging contract labour in any firm or project:

1) The Principal Employer (Your Organization) must be registered under the CLRA.
2) Your organization must be registered under PF and ESI coverage.
3) Try to engage only those contractors who have prior registration under CLRA. Otherwise, issue FORM V to all and determine the required daily manpower to be engaged at your site. Ensure that the number does not exceed the approved threshold limit as per the license.
4) Obtain insurance coverage for Public Liability Insurance (PLI) and employee compensation in case of any casualties at the site.
5) Maintain canteen and welfare facilities at the site according to norms.

If the principal employer has only 15 people, including the CMD and all employees on regular roles, and if everyone's salary is above Rs. 20,000/-, and they give 100% back-to-back work to other agencies, then in this case, the principal employer should have CLRA registration.
