Stuck in a Notice Period Dilemma: How Can I Get My Company to Accept My Resignation?

I'm working in a web design company in Navi Mumbai. I got a chance to work with an MNC. In my current company, there is a 2-month notice period or a 2-month salary in lieu clause. I am giving an 18-day notice period, and for the remaining days, I am ready to pay whatever amount is required. However, my company is not allowing me to do this. They are not giving me an exact date. They are saying either serve the 2-month period or wait until we find a replacement. I am willing to wait for the next 15 days but not more than that. The company has a buyout option but is still not releasing me. Please tell me what I should do in this scenario.

In fact, in this same company, there is another problem. They have been deducting PF for the last 5 months but have still not provided PF numbers to employees. Not a single employee has a PF account number.

Notice Period Buyout

If your contract specifically states that you can buy out your notice period, it is your right. Draft a letter stating your intention to leave the employment, quoting exactly what your contract says. Check for any hidden clauses your employer may have included in the contract to prevent you from doing so. If there are none, this should work fine. Prepare a Demand Draft in favor of your company or a check from an account other than your salary account. A Demand Draft is preferable. The amount must be equivalent to your 2-month buyout amount. Then send it by registered post with acknowledgment due (AD). This means you will receive an intimation when they receive it, providing legal coverage. You are no longer required to work there. Provident Fund (PF) Issues

Your PF is your right. Contact your area PF enforcement officer and lodge a complaint that the UAN Number and PF number have not been provided. They will take care of the rest.
