Not Able To Serve Notice Period! What To Do

Sir,

I have a case where The employer has given job to a prospective employee(Fresher) A in Company X and the prospective employee had accepted offer letter and joined the Job and after working for 25 days A has received a mail that she has got Offer Letter from Company Y with Better Role & Package through campus placement Result and is given immediate joining after 10 days.

Now A has submitted Resignation to company X stating that she has personal issues on Official note through email and received a reply that she has to serve 30 days notice period.

Kindly note: A has given Intermediate original certificate to Company X for background verification and the employer stating orally that A will receive certificate only after 60 days

Kindly Suggest what should A do now in Since she Has two problems

1. She should get Relieving from Company X

2. She should get her Original Intermediate certificate which she has to submit at Company Y on date of Joining along with other SSC, Graduation certificates

Pls Give your valuable suggestions

Dear Annonymous,
The issue should be dealt -
1. Is the Appointment Letter of X company specify any Probation Period ;
2. If so, either party can say good bye during this period - no need of Notice period
3. In the event of no notice period clause, Is the Appointment Letter of X company specify any Notice Period ;
4. If during probation period, the X has no right to withhold the original Certificates.
Pls ponder over the above points.

1.Sir No Appointment Received by employee only offer letter was given at time of joining and employee submitted resignation on 25th day of joining
2.Employee A has submitted resignation via email to Employer X on 25th Request mentioning the effective date of Resignation to be 26th of this month
Is the employee liable to forgo the salary for which she worked upto 25th and If so she is willing to forgo to get Original Certificate and Relieving
