Facing Suspension Over Alleged Illegal Strike: How to Navigate Unfair Employer Practices?

VIKRAM GHADGE
Dear sir,

1) My company suspended us under the reason of an illegal strike and held a domestic inquiry. However, in the suspension letter, the company forced us to sign the attendance book daily at the main gate for subsistence allowance.

2) Subsistence allowance and traveling allowance are not given on time.

3) Also, attendance allowance and performance allowance are not calculated in the subsistence allowance.

4) The suspended employees' Diwali bonus for the financial year 2015-2016 has not been given to date.

Please provide us with your suggestions.

If the management has suspended you and your colleagues for an illegal strike, why was such an opportunity given to declare it illegal? Have you not provided proper advance information and time to present your demands? Are you engaged in essential services for the department? Have you informed the Labour Authorities or the ALC about this situation as well? Kindly update us first.

Now, if the management has declared it illegal and initiated a domestic inquiry, the outcome may be somewhat unfavorable. However, as advised, try to cooperate in the inquiry by attending daily. You will receive your salary advance on the date of wage distribution.

Please provide detailed information on the reasons for the strike first, and then we can offer further assistance.

Regards
