Gratuity Calculation Confusion: How Do I Confirm Eligibility and Get It Right?

Hi, please assist us with the matter of gratuity calculation based on the below-mentioned salary structure. Join Date: 10 April 2010 Resign Date: 19 Oct 2016

Salary Details:

- Basic: 12500/-
- HRA: 4375/-
- Conveyance: 800/-
- Medical: 1250/-
- Other: 4575/-
- Employee Contribution: 1500/-
- Total Salary: 25000/-

May I inquire with management about gratuity eligibility? If so, kindly advise on the process and also provide a calculation sheet for gratuity considering my salary structure.

Dear Mr. Singh,

Gratuity is payable at 15 days' wages for every completed year of service and part thereof in excess of 6 months.

The tenure stated above amounts to 6 years, 6 months, and 10 days. Hence, Gratuity is payable for 7 years.

The calculation is as follows: (Basic divided by 26) multiplied by 15 multiplied by the eligible tenure - (12500 / 26) * 15 * 7 = Rs. 50480.77/-

You can make an application for Gratuity in Form "I" under the Gratuity Act, which you can download from the Internet.

Dear sir,

Please download Form-I and after filling in complete details, send it by Speed post and mail attaching a scanned copy of the same to your employer. The act states that Gratuity is payable upon application, so your employer should not use any excuse or plea that you never applied for it.
