Stuck Without My Relieving Letter: How Can I Get My Documents Released?

I was working at Consortium Clinical Research Pvt Ltd for 11 months with a 1-year bond. Since I received another good offer, I decided to resign from Consortium. When I informed them about my resignation, they requested me to pay 30,000 INR for breaking the bond and not serving the notice period. They mentioned that they would provide me with my relieving letter only after receiving this payment. I complied and paid the amount in cash and completed all handovers.

However, upon requesting my relieving letter, I was informed that the individual who received my handover did not complete the necessary work, resulting in a hold on my documents. Subsequently, both the HR and MD are not responding to my calls and emails. Despite fulfilling all handovers and making the payment, they are withholding my documents.

I would appreciate your guidance on how to proceed in this situation.

Anyway, you worked for 11 months, and to complete, there is only 1 more month. Anyway, you would have given a notice period of 1 month so you may complete a 1-year bond period.

Moreover, employee bonds are not valid in India, and no employer can take a bond from the employee. Do you have a receipt for giving 30K in cash?
It would be better if you go to the office directly and meet the respective person.

Thank you for your reply. My parents and I went to the office directly to meet him, but he was not there. He asked me not to involve my parents in it, providing silly excuses and deliberately delaying the matter. As this is urgent for me, the intentional delays are causing frustration. I have already waited for more than 40 days, and he is still asking me to wait further. Please advise on the legal steps I can take or if I should report this to the police. This mistreatment is not only affecting me but has been done to many others as well. It is crucial that they do not repeat this behavior towards any other employees.

You may file a police complaint for harassment and also file your complaint with the Dy Commissioner of Labour of your jurisdiction for obtaining terminal dues and a relieving letter.

If you have the bond paper with you and also the cash receipt of the bond amount recovery, you can take legal action against the company.

The girl has asked for the proof of the money given to her. I hope you have some proof of the same. If yes, then proceed and file a complaint. If you do not have any proof, then learn from your mistake and forgo the money.
