How Can I Get My Relieving Letter After Leaving Without Completing Notice Period?

I worked for an organization for one year, and due to disagreements with the management, I resigned from my position, which has a three-month notice period. I served one month of the notice period, but due to an emergency, I had to leave for my hometown without completing the notice period. I explained the reason to HR, and they informed me that I did not follow company policies, so my employment status has been marked as absconded.

According to my appointment letter, if an employee abandons their services, the company will recover the notice pay as per the terms and may take further appropriate actions. Currently, my one-month salary, medical insurance amount, and Per Diem are pending with the company. When I contacted the Accounts department, they mentioned that these amounts would be settled in full and final payment. However, HR states that due to my non-compliance with company policy, the full and final settlement cannot be provided.

I am seeking advice on how I can obtain my relieving letter.

Sorry, my friend, you have violated the terms of the contract. Legally speaking, you are entitled to wages under the Andhra Shops and Establishment Act. If the company wishes, they can proceed with a suit under the Indian Contract Act for the violation of the notice period. Both issues are separate as they are governed by different laws. However, the labor department, whose assistance you need to enforce this, will not take you seriously if you have breached a contract.

Thank you for replying. In that case, can I get a service letter from the organization? They are not even providing me with the service letter, and moreover, I have joined the company only after they put my employment status to abscond and have not even settled my accounts.
