No Buyout Option For Notice Period

Dear All,

I worked for an organisation for one year and due to disagreements with the management I had resigned for my position which has three months notice period. I had served one month notice period and due to some emergency condition I left to my hometown without serving notice period. I explained the reason to my HR and I got in reply that I have not followed company policies so they have put my employment status to abscond. In my appointment letter it is clearly stated that in case of employee abandoning the services , the company will recover notice pay as per the terms and in addition to taking any other action as deemed appropriate. My one month salary, medical insurance amount and Per Diem is with the company and when I call to Accounts department they are telling it will be given in full and final settlement but HR is telling me I have not followed company policy so the full and final settlement cannot be adhered. Can anyone help me what I can do in order to get my relieving letter.

Sorry my friend you have violated the terms of contract. Legally speaking you are entitled to wages under Andhra Shops and Establishment Act. Then if the company wants they can proceed a suit under Indian Contract Act for violation of Notice period. Both things are indifferent as are governed by different laws. But the labour department with whose help you have to enforce this, will not take you seriously if you have violated a contract.

Thank You for replying, in that case can I get service letter from the organisation because they are not even providing me the service letter and moreover I have joined the company only after they put my employment status to abscond & not even settled my accounts.
