Dear HR Professionals and Seniors,

We have searched to get present minimum wages for contract labour under The Contract Labour (Regulation and Abolition) Act, 1970 and the Andhra Pradesh Contract Labour (Regulation and Abolition) Rules, 1971.

But we could not able find to present minimum wages exactly.

We have found only Central_Sphere_01.10.2016.

Is this Central_Sphere_01.10.2016 correct or not as per the act of contract labour under The Contract Labour (Regulation and Abolition) Act, 1970 and the Andhra Pradesh Contract Labour (Regulation and Abolition) Rules, 1971?

We have received contract labour license from Office of licensing officer & joint commissioner of labour, Guntur Zone, Guntur.

Is the Central_Sphere_01.10.2016 applicable to Guntur Zone, Contract labour office?

or

Is Guntur zone contract labour office following any other present minimum wages for contract labour?

If any present wages available as per Guntur zone contract labour office for contract labour, Please provide the same.

Contract labour is not a scheduled employment but an arrangement to get the work done. Therefore, you will not find a minimum wages separately for contract labours. But what you have to do is to take the work done by these contract labours and pay the minimum wages as applicable to that employment. For example, if you have deployed labour to do welding job, you pay minimum wages applicable to welder. If you have deployed gardeners you pay wages as applicable to gardeners or if you have persons to do the work of loading and unloading activities, pay wages applicable to loaders.

PFA copy of AP Govt Gazette dated 19th March 2012 wherein the Andhra Pradesh Govt has notified MW exclusively for the contract workmen. Moreover in another GO dated 07 11 2012, the AP Govt has informed that revision in DA for the contract workmen will have to be done once in six months as like other workers. We have also attached latest press note on DA for your ready reference. In case if you require any further help / supprt or details / documents, pl contact us.

Please read the notification carefully. The notification says that the prescribed rates should be paid to contract workers engaged in such activities where no separate Minimum Wage rate has been fixed. That means if you have contract worker doing a particular work for which minimum wage has been fixed by the government, that wage should be paid and on the other hand, if there is no such rate available, you can pay the wages as per the uploaded notification.

The querist had asked for MW applicable for the contract labour and he did not mention the Industry where he had deployed the contract labour. Normally the Govts are notifying MW Industry wise and not for category wise. For example Welder, Gardner or loading & unloading workers are fixed with different wages and DA in different Industries.

I am bit confused. In A.P Contract Labour wage is fixed separately. CPI points are common. But rate per CPI points mentioned in Contract Labour say Rs. 6.55 for unskilled, Rs. 7.75 for Semi skilled; Rs. 9.50 for skilled and Rs. 11.85 for highly skilled. So on and so forth the rate is available for office staff. CPI points published for every six monthly taken into and Labour Dept is works out the wage and publishing. Further, workers covered under US, SS, S, and Hs are also mentioned. As mentioned rightly the DA points published for 1-10-2026 to 31-3-2016 is 1208. In case of Andhra Pradesh Mr Natraj is in correct line

Variable DA (Cost of Living Allowance) is Rs, 11.85, Rs 9.5, Rs 7.75 and Rs 6.55 per point of increase in the Cost of Living Index over and above 847 points (base 1982=100) respectively for Highly Skilled, Skilled, Semi Skilled and Unskilled employees. As per notification each point of increase in CPI above 847 will earn DA at the rate of 11.85, 9.5 etc for each category of employees. If the average CPI for the next 6 months period as per notification is 1208, the points which will attract DA is 361 points, ie, 1208 minus 847. Therefore, a highly skilled person will get DA at the rate of Rs 11.85 for 361 points, or 361 X 11.85 or Rs 4277.85, a skilled worker will get DA at the rate of Rs 9.5 for 361 points, or 361 X 9.5 or Rs 3429.5 and so on.
