Am I Entitled to My Salary Without an Appointment Letter After Resigning?

rahulniec
I have worked for a pharma company in Delhi. They first issued me an offer letter, and after more than a month of working, they didn't give me my appointment letter. I asked them for the same, but instead, my MD told me that if I do not achieve my target (which was not given at the time of the offer letter), then he will not give me my salary for the current month. Therefore, I have given him my resignation.

Am I eligible for remuneration? Since I have not received my appointment letter, will they charge me for not giving a notice period? My 15 days' salary is unpaid by the employer.

Kindly address my issue.

Thanks,
Rahul

Firstly, if they say they will not give you your remuneration, they are committing wrongs in two different acts:

1) Shops and Establishment Act
2) Indian Contract Act

So, simply, you can go to your city labor office and file a complaint under the Shops and Establishment Act for the refusal of wages.
