Hi,
Require your help , One of our employe meet with an accident when coming to office she is not covered under ESI , she is on Medical leave for almost 2 months ,.
Is their any policy in worker compensation so that we can reimburse her salary .

Since she is not covered under ESI Act, the employer will have to give her compensation as per Employees Compensation Act. This would include reimbursement of medical expenses incurred by her and payment of disablement benefit as per the Act.
Benefits payable for permanent disablement and death are based on the wages and the age factors. The lesser the age of the employee the more will be the benefits. In the case of death, the compensation will be 50% of wages multiplied by the age factor subject to a minimum of Rs 120000 and in the case of permanent disablement it is 60% of wages multiplied by the age factor subject to a minimum of Rs 140000. Maximum wages for these purpose shall be Rs 8000.
Now, if there is no permanent disablement, then the benefit will be 25% of wages for every 14 days. Here also you can limit the wages to Rs 8000.

Nidhi, your question is unclear
Are you asking about your liability under workman compensation act ?
Or are you asking if there is an insurance policy under which this can be covered and recovered ?
If you take a policy now, it will definitely not cover previous accident.
If you have an existing policy, how can we know what it covers, that you will know if you read the act
