Can Terminated Employees for Non-Performance Still Get a Relieving Letter? Seeking Clarity

I have a doubt. If an employee is terminated from the company for their non-performance on an immediate basis, will they be eligible to receive the relieving letter from the company? I request you to kindly clarify this doubt as soon as possible.

If the services of an employee are terminated due to non-performance of work, why insist on getting a relieving letter? I am certain that if the letter is provided to the employee, the employer will likely mention the reasons, which may not reflect well for future employment opportunities.

However, it is acknowledged that the employee is entitled to receive a relieving letter.

Are you referring to the termination letter? Many organizations, despite terminating an employee, will issue an experience and relieving letter, considering the future of the employee. It is better to clarify the same with the HR department.

In my view, you should give him an experience letter where you don't have to mention the performance. The relieving letter, in this case, would be negative for the person, while the experience letter would create a win-win situation for you and the employee as well.

Apart from the above views and their comments, if an employee is terminated, then the termination letter itself is the relieving letter; there is no need to ask for a separate relieving letter. As commented above, please speak to your company and avoid getting a termination letter, which may hamper your career ahead. Hence, ask them to accept your resignation letter of a backdated nature instead and obtain your experience/relieving letter through mutual understanding.
