Facing Termination While Pregnant: Can I Fight for Fair Compensation?

I am working in a private limited company in Delhi and have been employed there for the last two years. Recently, the company informed me that I will be terminated and must leave in 2-3 days due to alleged bad performance. However, I have never been previously criticized for any negative performance or behavior.

The company has indirectly requested my resignation, offering one month's CTC, and is threatening to terminate me if I do not comply. In my case, I am five months pregnant.

I need suggestions. Can I refuse to resign and ask them to provide me with six months' compensation due to my pregnancy? Alternatively, can I file a case against the company for forced resignation? Is there any chance to receive compensation for the duration of my pregnancy, as I am unable to secure a job in the market due to my condition?

Clarification Needed on Employment and Performance Details

There are a few questions you need to clarify:

1. Have you been working for the last two years in the same company, and has your appraisal been done? If yes, what were your last ratings, or were there any concerns highlighted to you during the performance discussion?

2. Were you married before joining this organization?

3. What kind of organization are you working in, and at which level?

4. Have you informed your supervisor about your pregnancy before these new developments?

5. What is the notice period as per the appointment letter?

In any case, the organization cannot force you to resign without any dialogue or communication, or a PIP process on the grounds of non-performance. Please consult with the Local Labor Officer. You may lose the job or resign in the future because of a bad relationship, but you will get all your compensations applicable to you.
