Am I Entitled to Severance Pay if Let Go During Probation for a Lower Offer?

Severance Payment Eligibility During Probation

Recently, I was hired by an organization on a 9-month probation as a Sr. Manager - Business Development. Within 15 days, the employer wanted to let me go as they found someone willing to accept a lower CTC. My current CTC is 18 lakhs per annum. Am I eligible for a severance payment, considering they have extended my service for another 15 days? If I am eligible, how much am I entitled to, and what should I do if they refuse to pay?

Note: I am not entitled to any benefits during my probation period, such as PF, leave pay, gratuity, etc.

There is no mention in the post about the conditions of severance in the contract of service. Even otherwise, the employer has the right to terminate the services of a probationer without assigning any reason or on the ground of unsuitability to the organization. Therefore, in my opinion, the poster is not entitled to any severance pay.

Dear RENIEE,

As explained by Mr. Umakanthan, it appears that you, due to being on probation, are not eligible for severance payments unless any clause of your employment specifically covers that. For instance, we had a clause for an employee stating that we would give at least 3 months' notice in case his services were no longer required, and he also had to give us three months' notice in case of resignation.

Regards,
Col. Rathi
