Is It Fair for My Bank to Demand Bonus Repayment After Resignation? What Should I Do?

Devnaashvin
Hi,

I worked in a private sector bank for the last 8 years as a clerk. Last month, I resigned from my job due to some personal issues. I have also served my notice period of one month. I had an OD Account, and I have adjusted it. Now, to get a proper relieving order and my original certificates from the bank's HR department, they have asked me to pay back the ex gratia and bonus paid to me for the last financial year.

Kindly advise on whether it is a valid claim by the bank and what I should do next.

It is unfair to demand repayment of an amount, especially an amount to which an employee is legally entitled, in order to be relieved from duties. This should be raised as an industrial dispute. The bank has committed an illegal act by also collecting educational certificates. Retaining them is further misconduct, and action should be taken against this.
