Medical Leave and ESIC: Can Workers Still Get Benefits Without Contributions?

If any contract workman is medically unfit for more than 90 days and under treatment, ESIC will continue. If this workman has not submitted any contributions to ESIC and EPF in this condition, will the workman still be able to avail all benefits or not. Please confirm as soon as possible.

Understanding Benefits Under the ESI Act, 1948

Benefits under the ESI Act, 1948, and the rules/regulations framed thereunder are available for a certain period, provided the insured person is entitled to these benefits. The appropriate branch office of ESIC, to which the insured person is attached, can certify which benefits the insured person is entitled to, even after exhausting the 90 days mentioned by you. Therefore, it is advisable to contact the said office for confirmation.

If a workman is medically unfit and receiving continuous treatment under ESIC, allowing him medical rest, he will remain eligible until the completion of treatment (medical fitness), regardless of his zero contributions, subject to his entitlement at the beginning of the treatment. His entitlement will be reviewed once he regains fitness and again requires general sickness benefits. However, in the case of an injury during the discharge of his duties, he will be entitled once again.
