How to prove that you were a permanent or regular employee in a company. What are the documents required for the same?

To prove that you were a permanent or regular employee in a company, there are several documents you can provide as evidence. These may include:

1. Employment contract or offer letter: This document typically outlines the terms of your employment, including your job title, responsibilities, salary, and status as a permanent or regular employee.

2. Payslips: Your payslips can demonstrate your regular income from the company, which supports your status as a permanent employee.

3. Tax documents: Tax forms such as W-2 or 1099 can also prove your employment status and relationship with the company.

4. Employee handbook: The company's employee handbook may contain information about your employment status and benefits as a regular employee.

5. Performance reviews or appraisals: Positive performance evaluations can further establish your status as a valued permanent employee within the company.

By providing these documents, you can effectively demonstrate your status as a permanent or regular employee in a company.

Determining Permanent Employment Status

When you are recruited and appointed to a permanent post, you become a permanent employee subject to the satisfactory completion of any prescribed probationary period and confirmation in writing by your employer. Your appointment order and confirmation order issued by your employer serve as the relevant documents authenticating the permanent nature of your employment. In the absence of these documents, the permanency or regularity of one's employment must be determined through inference.

Factors Influencing Employment Status

The factors to consider in discerning whether one is employed as a permanent or regular employee in an establishment include the nexus between the nature of one's job and the main activity of the establishment, the typical daily work hours or seasonal demands, the involvement of a third party through whom services are engaged, any specific contracts outlining tasks or assignments, the fixed tenure of employment, the compensation structure, the right to unilateral termination, the length of continuous service, periodic salary increases or increments, among others. These elements collectively contribute to determining the employment status in an establishment.

Thanks, Sir, for the reply. I have salary slips, offer letter, appointment letter, yearly salary hike letter mentioning CTC. Can I use them as proof to show that I was a regular employee.

Dear Rana,

Salary slips, offer letter, appointment letter, yearly salary hikes letter mentioning CTC, are not proof of an employee having been made a permanent or regular employee. Permanency does not accrue automatically, even if appointed against a permanent post, unless declared so by the employer. If you have a letter declaring you permanent only then you can be considered a regular employee.
