Permanent Or Regular Employee

how to prove that you were permanent or regular employee in a company. What are the documents required for the same?

When you are recruited and appointed against a permanent post, you are a permanent employee subject to your satisfactory completion of the period of probation,if any prescribed and confirmed as such by your employer in writing. Therefore, your appointment order and confirmation order issued by your employer are the relevant documents authenticating the permanent nature of your employment. In the absence of these documents, permanency or regularity of one's employment has to be determined by inference only. The nexus between the nature of one's job and the main actvity of the establishment, the normal hours in a day or the seasons of a year one is required to be at the disposal of the employer, the presence of a third party through whom services are hired by the establishment for its work, the specific contract, if any entered in between the employer and the individual providing for aspects like specific assignments or work to be performed, fixed tenure of employment, fixed or variable compensation through out the entire tenure, right to unilateral termination etc.,the continuous length of service, periodical hike in salary or increments and the like are the factors to decide whether one is employed as a permanent or regular employee in an establishment or not.

Thanks Sir for the reply. I have Salary Slips, Offer Letter, Appointment Letter, Yearly Salary Hikes letter mentioning CTC. Can i use them as proof to show that i was regular employee.

Dear Rana,
Salary Slips, Offer Letter, Appointment Letter, Yearly Salary Hikes letter mentioning CTC, are not the proof of an employee having been made a permanent or regular employee.
Permanency does not accrue automatically, even if appointed against a permanent post, unless declared so by the employeer. If you have a letter declaring you permanent only then you can be considered as a regular employee.
