How Should I Navigate Salary and Return-to-Work Policies During Maternity Leave?

Salary During Maternity

Half of the salary payment would be given at the beginning of each month during the three-month maternity leave tenure. The remaining half payment would be made once the employee rejoins, in the following three months.

Return to Work

a) The female employee who does not report to work within five (5) days after the end of her maternity leave may be considered to have resigned.
b) If the employee fails to return to work, the company reserves the right to forfeit half of the due salary.

We already have a 2-month notice period to serve, so even if I resign, I will have to serve for 2 months after rejoining.

Please suggest.

Any policy of any company is totally useless in front of the Maternity Act. The Act is supreme, and everyone has to follow it.

All three points are illegal. So, you can challenge.
