Navigating PF Withdrawal and Employer Issues: How to Handle Delays and Missing Documents?

I resigned from Company B in Dec 2006. Actually, I left Company A in Aug 06 and joined Company B in Sep 06. However, I did not like the environment, and my health was deteriorating. I discussed my situation with HR and my Manager, and they accepted my resignation. When I requested a release letter and an Experience letter, they only sent me the final settlement amount. I had received a relocation amount when I joined Company B, which I was supposed to repay if I left before completing one year, as per the offer letter. I have not repaid anything to the company and have not received any letters. I am currently working abroad. My questions are:

1) I want to withdraw my PF (I have already transferred my Company B PF to a new account in Company A, and I only have the PF account number). Form 19 requires the employer's signature; if the employer refuses to sign, what should I do? Can the employer withhold the PF amount?

2) Will I receive the full PF amount (employee and employer contributions)? Is there any issue with withdrawing after a year?

3) Can you guide me through the procedure?

4) Can the employer withhold my Form 16 & TDS in the case of non Full & Final settlement?

I apologize for the numerous questions. Your assistance is greatly appreciated.

Dear Diwakar,

The company cannot refuse your PF money. Please understand that these are statutory issues which all companies are bound by. Fill out all the required forms. Even if it is 1 year late, there is no problem. Once you have submitted the forms, it might take up to 2 months on the higher side for the money to be transferred.
