Resignation and Notice Period Challenges

I gave my resignation on 1st July 2016 due to poor health and decided to relocate to my hometown to find a new company nearby. I have a 2-month notice period. During the notice period, I took leave due to health issues, being present for only 10 days in the first month and 3 days in the second month. I transferred knowledge to one employee during this time and informed HR and my manager via email that the knowledge transfer was complete. However, the manager informed me that the employee I transferred knowledge to had been moved to another project and asked me to provide the knowledge transfer to another employee. I have a buyout option for the remaining holidays, but the manager has not released me, insisting that I complete the full 2 months.

As of now, I have stopped going to the company. I have tried to contact HR but have not received a response. What should I do to obtain my experience certificate?

Are you employed with any company now? How long have you been working with your last employer? Why didn't you speak with your Manager/HR before stopping going to work with your last employer? They may clearly tag this as a "No Show/Absconding" case and may withhold your employment papers. I have seen a lot of cases wherein an employee receives an offer and suddenly claims to have health issues and makes hasty decisions. Speak with your ex-boss and try to sort it out, rather than asking us for advice.

Three years in this company. I spoke with the manager; he said we will not relieve you until you complete the whole first year and two months. Then I tried to speak with HR. HR said, "I am busy now." I waited for 4-5 hours and went to HR 3-4 times, but she said she was busy. I think they have already planned to make me an absconding employee. I have no way out now. What should I do to get my experience certificate?

I talked with my junior manager, and he said to give Knowledge Transfer (KT) to another new employee. When I complete the KT, he will then talk with the senior manager to try and reduce my notice period. I have no other option but to continue working within the same company.

However, I lost the new job because the new employer could not wait for me any longer. They needed an urgent candidate, and they had already been waiting for me for the last month.

Now, when I am released from here, I will need to search for a new job again. I don't know how many days or months it will take for me to secure a new job. It can be very frustrating for anyone facing this type of situation.

I give KT to another employee, but after 2-3 days, that employee has an accident, so he is not coming to the office. My junior manager said he will release me soon. Every week he said so, but still, I am not able to be released. I have completed 22 working days, which is equivalent to the completion of 1 month, but still, they are not releasing me.

So, my question is: Does the employer have the right to forcefully require work from an employee if the employee has the option of a buyout?
