Weekly Holidays Under Section 52 of the Factories Act

Section 52 of the Factories Act states the following:

Weekly holidays:
(1) No adult worker shall be required or allowed to work in a factory on the first day of the week (hereinafter referred to as the said day), unless:
(a) they have or will have a holiday for a whole day on one of the three days immediately before or after the said day, and
(b) the manager of the factory has, before the said day or the substituted day under clause (a), whichever is earlier.

Provided that no substitution shall be made which will result in any worker working for more than ten days consecutively without a holiday for a whole day.

As per the above section, employees can be asked to work on weekly holidays based on their willingness. However, they should be given a day off within three days of working on the weekly off. You should ensure that no employee works more than ten days consecutively. They must be given 24 hours of rest within ten days of continuous work.

Hi,

The Factory Manager needs to seek approval from the Labour Department at least 3 days before and provide a valid reason. Additionally, compensation must be provided within 3 days.
