Ex-Employer Withholding Security Money: How Can I Get My Salary Back?

I have completed my contract and not renewed it again. According to my contract, I have fulfilled my duties. However, my ex-employer is not giving me my security money (one month's salary). What should I do? Can you please tell me how to deal with my employer? Please suggest something. Can anyone help me to file a case in the labor court? Where should I file this case - in the labor court or civil court?

You cannot file a case against your employer just because your contract is not renewed. If the contract period has expired, you are not considered an employee. There is no obligation for the employer to offer you employment for an additional period.

Yes, you can ask for the last month's salary if it has not been paid or for any amount retained by the company. For that, you can first approach the Labour Officer. If you were employed for a fixed period in a managerial role, do not go to the Labour Office or Labour Court because they cannot assist you in any manner.

To address the issue of your unsettled and unpaid salary from your employer, you have several options. If your employer is a company, you can consider issuing a commercial winding-up petition. If they are not a company, you can issue a notice informing them of the initiation of a summary suit.

Additionally, you may choose to pursue a criminal breach of trust by approaching the local police station to file a First Information Report (FIR).
