Holiday - National and Festival Holiday Act
The National and Festival Holiday Act is applicable to all establishments in the country, irrespective of the law under which they are formed. It is mandatory to grant leave on the following 3 days: 26th January (Republic Day), 15th August (Independence Day), and 2nd October (Gandhi Jayanthi). For the rest of the festival holidays, the declaration depends on the discretion of the concerned states and establishments. The number of festive holidays can differ from state to state.
For example, in Karnataka, apart from the above 3 holidays, there are five other holidays, each of one whole day for such festivals as the employer may specify from the list of festivals specified in the Schedule appended to this Act in consultation with the trade unions, or in the absence of any trade union, in consultation with the employees or their authorized representatives in such a manner as may be prescribed.
In Orissa, one whole day on the 26th January, 1st May, 15th August, and 2nd October, and four other holidays.
In Pondicherry, 26th Jan, 15th Aug, 16th Aug, and 2nd Oct, and four other holidays.
