New Mom Struggling for Maternity Leave: How Can I Get Support from My Department?

I have a 2-month-old baby and I joined the service one month ago in the Rajasthan government education department as a teacher. At the time of joining, I had a one-month-old baby. I need maternity leave as per the rules. Please suggest to me or send me a circular to avail maternity leave. Officials of the department are saying that they don't have any rules for this case. They are saying if you have a baby after joining, then you can avail maternity leave. So please suggest to me or send any circular regarding this.

1. Sir/Madam, I think you are required to go through the Service Rules which are applicable to the employees of the "Rajasthan Govt. Education Department". It must have been mentioned in the terms and conditions of your employment.

2. When you were not employed in the said department at the time of delivery of the baby, then I think they cannot grant any maternity leave. Have you obtained a medical fitness certificate before joining the services of the said department?

Nothing is mentioned in the service rules regarding this. I need a new amendment of the service rules of Rajasthan, but I am not able to find it in hard or soft copy on any website. No one has clear knowledge about this case. Can I go through the court for my child who is just two months old?

In my opinion, you need to ask your immediate senior. If not satisfied, approach your department head or principal. Even after the delivery of a baby, government maternity leave is applicable for situations like miscarriage or surrogacy. To claim your leave, you will need to provide bonafide medical certificates and certificates of birth. It is advisable to start correspondence with the department, ensuring proper receipts or through speed post, and keep copies of relevant records. Allow appropriate time for the department to respond.

Before considering legal action, consult a good lawyer who can issue a proper legal notice. If you have an association, it is best to seek guidance through them. Best of luck.
