Navigating ESIC Coverage: Does Our Small Mumbai Office Qualify Under the Act?

Our company is in the business of shipping port operation. Employees who are at the port are covered under the Workman's Compensation Act policy as ESIC is not applicable in that area. However, we have seven employees working at our Mumbai office where ESIC is applicable. According to the ESIC Act, a minimum of 20 employees is required to obtain ESIC coverage. Is it applicable to us?

1. Sir, is your establishment in Mumbai only an office, or is some manufacturing work also taking place? If it qualifies as a factory, then the coverage should be based on 10 or more persons under section 1(3) of the ESI Act, 1948.

2. However, the issue of coverage or non-coverage of your establishment in Mumbai is a question of fact. I believe it would be more appropriate for you to seek guidance from the relevant office of ESIC in the jurisdiction where your unit is located in Mumbai.
