Can My Uncle Get a Pension from Both His Government and Private Jobs? How Does It Work?

Anil Akuri
Dear All,

Greetings!

My uncle worked in a central government organization and took voluntary retirement. Now he has been receiving a pension for his service with the Central Government. Later, he joined a private organization, worked for 13 years, and contributed to the PF as well.

Is he eligible to receive a pension for the service contributed to the private organization also? If so, how can it be availed? Is anyone aware of the process for this kind of case?

Thanks for your support.

Thanks, Anil

Dear Mr. Anil,

PF pension will not be denied on any grounds, provided the member has completed 10 years of service in EPS-95. The pension can be availed by submitting form 10D to the Sub-Regional PF office after endorsement by the employer.

Dear Mr. Anil,

PF pension will not be denied under any circumstances if the member has completed 10 years in EPS-95. Pension can be availed by submitting Form 10D to the concerned Sub-Regional PF Commissioner's Office after it has been endorsed by the employer.

Dear Anil,

As explained by Mr. Abbas, your uncle is entitled to PF Pension as well. Mr. Abbas is very knowledgeable about PF points.

I would like to add that as per government law, if a person is receiving two or more pensions, the Dearness Allowance (DA) will only be paid with one pension. In the other pensions, he/she will receive only the basic part.

I cannot provide a specific law section; this information is based on my experience with government departments and working with consultants. For more details, please contact the PF office or consult with an expert.

Dear Pan Singh,

Whatever pension one receives, there will be no deduction from the PF pension. This is because the EPS is not an additional benefit from EPFO or the government; rather, it is a return from the member's deposit.
