if any direct payment is made by the employer to the deceased's kin immediately after the casualty, will that form a part of compensation under WC act

Dear Mishra,
Pl refer to section 8 of the Employees Compensation Act,1923 which specifically deals with the distribution of the amount of compensation under the Act.. Particularly s.s (1) of Sec.8 mandates that the compensation under the Act (a) in respect of an injury resulted in death and (b) a lump sum as compensation to a woman or (c) to a person under legal liability shall be deposited with the Commissioner and any such payment made directly by the employer shall not be deemed as payment of compensation.

The term " legal liability" used inadvertently in my previous post may please be read as " legal disability".
