Workmen Compensation Dilemma: Does Immediate Payment to Deceased's Kin Count?

If any direct payment is made by the employer to the deceased's kin immediately after the casualty, will that form a part of compensation under the WC Act?

Please refer to Section 8 of the Employees' Compensation Act, 1923, which specifically deals with the distribution of the amount of compensation under the Act. Particularly, subsection (1) of Section 8 mandates that the compensation under the Act for (a) an injury resulting in death, (b) a lump sum as compensation to a woman, or (c) a person under legal liability, shall be deposited with the Commissioner. Any payment made directly by the employer shall not be deemed as payment of compensation.
