Will Company Return My All Education Documents?

I joined one of the small IT firms in Mumbai on 11th January 2016. At the time of joining, they asked me to submit the original educational documents to the company for security, and they also said they would give me an acknowledgment letter for the same. However, to date, I haven't received that. Now, after working there for more than 4.5 months, I am the only developer in this office. The company doesn't even have a company name board outside the office. I am very worried about my future because of all these things. Now, I am thinking of leaving this company after getting a new job. Will the company return all my educational documents?

Company has no right to retain your educational certificates. Ask for them back immediately, making any excuse. Leaving certificates with them can lead to difficulty in exiting. The company can lose them or spoil them due to negligence, and they can deny it since no receipt is given. Are they paying the salary regularly? What about business orders? Look around discreetly for other jobs if you have doubts.

How can you expect members of this forum to give an answer to your question. We do not know the Company or its owners, their attitude, ethics, or honesty. So how can we say whether or not they will give the money back....

If you are asking whether you made a mistake in giving them your certificates, the answer would be yes. You have made a mistake.

Right now, you need to concentrate on how to leave your current organization without any difficulties. Forget about the company and its loyalty to you; just focus on your career and leave through the proper process. They will definitely return your documents. There are many job opportunities in the market, so upload your CV on job sites or consult with a recruitment agency. Stay confident in your decision to move forward.

Normally in private companies, people will be joining as a trainer without experience. They will be learning the work and leaving after 3 months or more. In such cases, the company is paying a salary without any contribution to the company from them. It has become a regular practice nowadays.

Because of this reason, they will ask the candidate to work for at least one to two years minimum. It will be agreed upon by the candidate. Also, they will ask to deposit their educational documents as a measure of moral binding.

In such a case, if anybody wants to leave early, they can request the management and leave by taking the certificates.

As I know, most international standards or government laws do not allow any behavior of keeping the employees' personal documentation (e.g., passport, certificate...). All behaviors like that can be considered misconduct. In this particular case, you totally made a mistake with your childish actions :D. I think you should remember and find any evidence of your personal documentation that was given, or anyone who can bear witness for you. Just wait for the right time to ask them if you do not want to lose it forever. If you cannot find any evidence, the hint is given in the row below:

You can talk with the person who is keeping your personal documentation in person with a recorder tool. In the conversation, try to discuss more about your flashback, attempt to make them reveal the evidence, and get everything back from their mouth for your next step.
