Store Closure Due to Lease Expiry: Will I Still Get Paid While on Payroll?

llndrkshwh28@gmail.com
Dear Sir,

I am working as a store manager in the retail sector for a Western wear brand since 2012. My question is, as I have been an on-roll employee of the company since February 2016, my store has been shut down due to the lease agreement expiring with the mall. However, I have not received any confirmation regarding my salary for the past three months, even though I am still active on the payroll. Will I receive my salary in this case?

Thank you.

Yes, you are entitled to your salary for the last 3 months. Please ask in writing to your employer to clear the outstanding salary. If they don't, then you can approach the appropriate forum to recover the same. You can consult with any labor law advocate with all documents for better advice.

But sir, now my company is processing my FNF, and I informed them that I am entitled to receive my past three months' salary because I am still on the company's payroll. The company is telling me that I will not receive the salary because my last working day at the store was February 15, 2016. However, I have not received any written notification regarding when the new store will open, and neither will I get my past three months' salary nor will my staff receive their salary. Despite this, we are still active on the company's payroll. I am requesting your advice on this matter.

Regards

This verbal communication has no value. Ask for your outstanding dues in writing and send it through registered post with proper acknowledgment. As suggested earlier, you can seek the help of a labor lawyer if you feel so.
